Chapter 12: drafting legislation for sprouts and seeds intended for the production of sprouts
Within the framework of activities related to Negotiation Chapter 12, Policy and Legal Advice Centre (PLAC III) project has provided support to the Ministry of Agriculture, Forestry and Water Management in drafting the acquis-compliant legislation for sprouts and seeds intended for the productions of sprouts.
In the cooperation with the beneficiary institution, PLAC III project experts were engaged in drafting the legislation compliant with the Union acquis. Experts Monika Cojanu and Maja Sandić presented relevant EU legislation as well as drafts of by-laws that enable transposition of Union acquis in the area during a workshop held on 24 November 2020.
Union acquis relevant for sprouts and seeds intended for the production of sprouts comprises of the Regulation (EU) No. 208/2013 on traceability requirements, Regulation (EU) No. 210/2013 on the approval of establishments producing sprouts and Regulation (EU) No. 211/2013 on certification requirements for imports into the Union of sprouts and seeds intended for the production of sprouts.
PLAC III project support resulted in the analysis of the national legislation and assessment of concordance with Union acquis, drafting of rulebooks transposing regulations on traceability and certification as well as in drafting procedures for approval of establishments, official controls and certification.
Project expert Monica Cojanu presented relevant Union acquis as well as experience of Romania as an EU Member State in the field. In particular, she focused on traceability requirements and certification procedure necessary to be followed in case of export of sprouts into the internal market. Project expert Maja Sandić presented draft procedures for approval of establishments, official controls and certification aligned with the EU requirements.
The online-held workshop gathered representatives of the Ministry of Agriculture, Forestry and Water Management (Plant Protection Directorate) and stakeholders – sprouts producers and nutritionists. In the debate, it was stressed that Serbia is yet to adopt a relevant law on sprouts intended for germination as well as to create a register of sprouts and seeds producers.
